This will inform you which data is collected by us during your visit to our online presence (e.g. as part of purchasing processes via our webshop) and what use is made of this data in detail.

We employ various techniques on our website to improve user friendliness, effectiveness and security. In this regard we, or authorised third parties, may retrieve information.

Because our webpage and the underlying technology are subject to constant change and development, alterations to this privacy policy may become mandatory. Personal data within the meaning of Art. 4 No. 1 GDPR are all data that are personally identifiable to you, e.g. name, address, e-mail addresses, details of your use of the internet.

§ 2 Lawfulness of Processing

The processing of personal data (cf. Art. 4 No. 2 GDPR) is legal if one of the following conditions applies (cf. Art. 6 para. 1 GDPR):

- The data subject has given consent to the processing of his or her personal data for one or more specific purposes;

- Processing is necessary for the performance of a contract to which the data subject is party or in order to take steps at the request of the data subject prior to entering into a contract;

- Processing is necessary for compliance with a legal obligation to which the controller is subject;

- Processing is necessary in order to protect the vital interests of the data subject or of another natural person;

- Processing is necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in the controller;

- Processing is necessary for the purposes of the legitimate interests pursued by the controller or by a third party, except where such interests are overridden by the interests or fundamental rights and freedoms of the data subject which require protection of personal data, in particular where the data subject is a child.

§ 4 Processing of Personal Data

With regard to the processing of personal data, a distinction must be made as to whether the data is only collected during a mere visit to our online presence, whether you contact us or subscribe to the newsletter or whether you carry out business transactions - in particular the purchase of products or services offered by us in general.

(1) Contact by E-mail or Via the Contact Form

When you contact us by e-mail or via a contact form, the data you have provided will be transmitted to us and stored by us in order to answer your questions.

This data is:

- Your name

- Your e-mail address

- Your telephone number (optional)

- The topic you specify ("Subject")

- Your interest

- Your message

- Your IP address

- The date and time of forwarding

- The subsequent communication between us


We process the data arising in this context for the purpose of communication with you and delete them after storage is no longer necessary, or restrict processing if statutory retention obligations exist.

If you contact us the legal basis is first of all Art. 6 para. 1 lit. a GDPR.

You have the right to revoke your data protection declaration of consent at any time. The revocation of consent shall not affect the legality of the processing carried out on the basis of the consent until revocation.


(2) Collection of Personal Data When Visiting Our Website

When using our website for information purposes only, i.e. if you do not register or otherwise provide us with information, we collect the following data:


Data That Your Browser Transmits to Our Server

If you wish to view our website, we collect the following data, which is technically necessary for us to display our website to you and to ensure stability and security:

- IP address

- Date and time of the request

- Content of the request (specific page), i.e. websites that you visit on our website,

- The amount of data transferred in each case

- Information about the browser type and version used

- The URL of the page you have previously visited (=Referrer URL)

The mentioned data will be processed by us for the following purposes:

- Ensuring a non-viscous connection of the website

- Ensuring comfortable use of our website

- Evaluation of system security and stability

The legal basis for data processing is Art. 6 para. 1 sentence 1 lit. f GDPR. The corresponding legitimate interest follows from the purposes for data collection listed above. Under no circumstances do we use the data collected for the purpose of drawing conclusions about you personally from them. We do not create user profiles of our website visitors.

The data will be deleted as soon as they are no longer necessary to achieve the purpose for which they were collected. With regard to the collection of data for the provision of the website this is done when the session is over.


Cookies

We also use cookies on our website.

These are small files that your browser automatically creates and that are stored on your device (laptop, tablet, smartphone, etc.) when you visit our website.

Cookies do no damage to your end device, do not contain viruses, Trojans or other malware.

Information is stored in the cookie that is connected to the specific device used. However, this does not mean that we immediately become aware of your identity.

The use of cookies allows us to make the use of our offer more pleasant for you. For example, we use so-called session cookies to recognize that you have already visited individual pages of our website. These will be deleted automatically after leaving our site.

The data processed by cookies is required for the above-mentioned purposes in order to ensure our legitimate interests in accordance with Art. 6 para. 1 sentence 1 f GDPR.

However, the complete deactivation of cookies can lead to the fact that you cannot use all functions of our website.

All personal data will be deleted or blocked as soon as the storage is no longer necessary.


Google Analytics

For the purpose of the demand-oriented design and continuous optimization of our pages we use Google Analytics (Art. 6 para. 1 lit. f GDPR), a web analysis service of Google Inc. (https://www.google.de/intl/de/about/) (1600 Amphitheatre Parkway, Mountain View, CA 94043, USA; hereinafter "Google"). In this context, pseudonymised user profiles are created and cookies are used. The information generated by the cookie about your use of this website such as

- browser type/version,

- the operating system used,

- device (PC, tablet, smartphone),

- resolution of the computer,

- referrer URL (the previously visited page),

- host name of the accessing computer (IP address),

- time of the server request,

- origin (country and city),

- language,

- downloaded and viewed files,

are transferred to a Google server in the USA and stored there. The information is used to evaluate the use of the website, to compile reports on the website activities and to provide further services associated with the use of the website and the Internet for the purposes of market research and demand-oriented design of these Internet pages. This information may also be transferred to third parties if this is required by law or if third parties process this data on behalf of the company.

Under no circumstances your IP address will be combined with other Google data. The IP addresses are anonymized so that an attribution is not possible (IP masking).

You may refuse the use of cookies by selecting the appropriate settings on your browser, however please note that if you do this you may not be able to use the full functionality of this website.

You can also prevent the collection of data generated by the cookie and related to your use of the website (including your IP address) and the processing of this data by Google by downloading and installing a browser add-on (https://tools.google.com/dlpage/gaoptout?hl=en).

As an alternative to the browser add-on, especially for browsers on mobile devices, you can also prevent Google Analytics from collecting data by clicking on https://tools.google.com/dlpage/gaoptout. An opt-out cookie is set to prevent future collection of your data when you visit this website. The opt-out cookie is only valid in this browser and only for our website and is stored on your device. Google Remarketing

This website uses the remarketing function of Google Inc. "("Google"). This function is used to present interest-based ads to visitors to the site as part of the Google advertising network. The visitor's browser stores so-called "cookies", text files which are stored on your computer and which make it possible to recognize the visitor when he or she visits websites belonging to Google's advertising network. These pages may then present advertisements to the visitor relating to content previously accessed by the visitor on websites that use Google's remarketing function. According to its own statements, Google does not collect any personal data in this process.

However, if you do not wish to use Google's remarketing feature, you can always deactivate it by making the appropriate settings at https://www.google.com/settings/ads.

(3) Newsletter

We are of course interested in informing you regularly about our latest offers and products. Among other things, we use electronic newsletters for this purpose. If you would like to receive a newsletter from us and sign up for it, we need your e-mail address and your consent to receive a newsletter. If you wish, you can also submit your salutation, first name and surname via the registration form so that we can contact you personally. After registration you will also receive an e-mail with a confirmation link, which you must click on. This identifies you as the owner of the e-mail address (so-called double opt-in procedure). If this confirmation does not take place without significant delay, the registration process is aborted and the previously entered data will be deleted from our servers.

You can either request the newsletter directly under the reference "Newsletter" or, in the case of ordering processes, also within the scope of the declaration of consent or, in the latter case, explicitly refuse to receive it.

The legal basis for processing your e-mail address is your consent (Art. 6 para. 1 lit. a GDPR).

In any case, related data will only be collected in order to be able to send you the newsletter. The e-mail address in particular will not be passed on to third parties. You can revoke your consent to the processing of your e-mail address for the purpose of receiving the newsletter at any time. An e-mail to datenschutz@pco-group.com or using the unsubscribe link at the end of each newsletter makes this possible without any problems.

With revocation of the consent the data stored until then are immediately deleted. This means that the data is only stored for as long as the subscription to the newsletter continues.


(4) User Registration / Webshop

For our commercial customers we offer a webshop. If you would like to place an order, you need to register first.

During the registration process, during which you receive personal and password-protected access, we store your data for the purpose of subsequent performance of the contract. When you create an account under "My account", the data you have provided will be stored revocably. You can have your customer account deleted at any time by sending an e-mail to info@pco-group.com, although we must comply with any statutory storage obligations.  

During registration we collect and store the following data from you:

- Salutation

- First name

- Surname

- E-mail address

- Phone

- Industry sector

- The desired way of receiving the invoice

- Company

- Address

- Comments

You must enter the above data in order to create an account. All other information can be provided voluntarily by using your customer account. You can always view and manage the total data you have stored in this respect via your customer account.

The legal basis for this results from Art. 6 para. 1 lit. a, b and f GDPR.

When using the customer account to order our products in the webshop, we use the data provided by you to process your order. The data collected is forwarded to external third parties as your address data is forwarded to a commissioned shipping company to carry out the dispatch of the ordered goods and, if necessary, your payment data is transmitted to our house bank.

The legal basis for the conclusion and execution of the contract with regard to data protection law is Art. 6 para. 1 lit. b and c GDPR. The data is stored for the duration of the contract and for the period of statutory storage obligations.



§ 5 No Disclosure of Your Data

Your processed personal data will otherwise neither be published nor passed on to third parties without authorization, in particular without your consent.

However, contract processors (cf. Art. 28 GDPR) support us in the provision of our services as IT service providers and in the context of hosting services. They have their registered offices in the European Union. Our contractors may have access to your data in the course of their work. We have concluded written contracts with our processors.

In all other respects we refer to the above explanations (if necessary passing on to house bank and suppliers).



§ 6 Your Rights

If your personal data are processed and stored in accordance with this data protection declaration, you are a" data subject" in the sense of the GDPR (cf. Art. 4 para. 1 GDPR). This gives you the following rights towards us with regard to your personal data:

- right to rectification or erasure,

- right to restriction of processing,

- right of objection to the processing,

- right to notification,

- right to data portability.

If processing is based on your consent, you have the right to revoke this consent with effect for the future,

Rights in Data Processing According to the Legitimate Interest:

According to Art. 21 para. 1 GDPR, you have the right to object at any time to the processing of personal data concerning you, which is based on Art. 6 para. 1 e GDPR (data processing in the public interest) or Article 6 para. 1 f GDPR (data processing to protect a legitimate interest), for reasons arising from your particular situation; this also applies to profiling based on this regulation. In the event of your objection, we will no longer process your personal data unless we can prove compelling grounds for processing that outweigh your interests, rights and freedoms, or the processing serves to assert, exercise or defend legal claims.
